Using A Protective Order To Keep Yourself Safe

The law defines domestic violence as physical contact, or the threat of contact, which causes an injury between family members, spouses or someone you share a close relationship with. Many victims of domestic violence seek a protective order, or restraining order, to prevent further harm from occurring.

In Iowa and Illinois, three types of protective orders are used depending on the situation and circumstances surrounding the request. You can file for an emergency protective order when you need immediate protection. However, emergency orders only last for three days.

Temporary protective orders last between five and 15 days but require more evidence to issue the order. The longest-lasting restraining order in Iowa is a final protective order, which lasts up to one year. As long as you provide proof that the protection is necessary, you can renew it on a yearly basis. In Illinois, interim orders of protection cover the period between the service of process and a final hearing. A judge orders a plenary order of protection after the final hearing.
