Iowa Expungement Eligibility: What the Law Requires

Dismissed Charges & Acquittals

Under Iowa Code section 901C.2, a court can expunge the record of a criminal case when all charges were dismissed or the defendant was acquitted of every charge. At least 180 days must pass from the date of dismissal or acquittal before filing the petition, though a court may waive that waiting period for good cause, such as a case involving mistaken identity. All court costs, fees, and financial obligations must be paid in full before the expungement can be granted.

Two circumstances disqualify a case from this type of expungement: a dismissal because the defendant was found not guilty by reason of insanity or a dismissal because the defendant was found incompetent to stand trial. Outside those two situations, a fully dismissed or acquitted case may be eligible.

Deferred Judgments

A deferred judgment places a defendant on probation without entering a formal conviction. When probation is completed successfully and all court costs and fees are paid, the record of that case is expunged. This pathway is built directly into the deferred judgment process rather than requiring a separate post-conviction petition, but confirming that all financial obligations are satisfied is essential before the record closes.

Alcohol Convictions & the One-Time Misdemeanor Expungement

Convictions for public intoxication or possession of alcohol under the legal age may be expunged once two years have passed since the conviction and no other convictions occurred during that period. The standard is straightforward, but the two-year clean-record requirement must be met precisely.

Iowa Code section 901C.3 creates a separate, one-time lifetime option for misdemeanor convictions. To qualify, more than eight years must have passed since the conviction, the applicant must have no pending criminal charges, must not have previously received more than one deferred judgment, and must have satisfied all financial obligations. A single application under this section can cover multiple misdemeanor charges if they arose from the same transaction or occurrence, but the lifetime limit means the option is available only once, regardless of how many qualifying convictions exist.

What Iowa Law Excludes from Expungement

Iowa law excludes a significant range of misdemeanor convictions from the section 901C.3 lifetime expungement. Ineligible offenses include OWI convictions, domestic abuse assault, harassment, stalking, weapons offenses, and sex offenses requiring placement on the sex offender registry. Felony convictions generally can’t be expunged under Iowa law. Simple misdemeanor traffic offenses are also treated separately and are generally excluded from these provisions.

Understanding what expungement does, and doesn’t do, matters just as much as knowing whether you qualify. An expunged record becomes a confidential court record no longer accessible to the general public, but it isn’t permanently destroyed. The record can still be accessed by court order and may remain available to certain law enforcement agencies and professional licensing bodies. For most background checks conducted by employers and landlords, however, the record may not appear.

Filing an Expungement Petition in Polk County

An expungement petition is filed in the district court where the underlying criminal case was heard. For Des Moines residents and others whose cases were handled in Polk County, that means filing with the Polk County District Court within Iowa’s Fifth Judicial District. The Iowa Judicial Branch provides standard court-approved application forms, and there is no separate filing fee to submit the application. Paying any outstanding court costs from the original case, however, is a prerequisite under most expungement pathways.

Once filed, processing time can range from a few days to several months. Other parties in the original case may have an opportunity to object before the court rules. Having accurate documentation of the original case outcome, dates, and financial history organized at the time of filing helps move the process forward without avoidable delays.
